We want an end to avoidable child deaths <\/span><span class=\"NormalTextRun AdvancedProofingIssueV2Themed SCXW251714441 BCX8\">as a result of<\/span><span class=\"NormalTextRun SCXW251714441 BCX8\"> unsafe child contact with dangerous perpetrators of domestic abuse. For this to happen, domestic abuse must be taken <\/span><span class=\"NormalTextRun ContextualSpellingAndGrammarErrorV2Themed SCXW251714441 BCX8\">seriously<\/span><span class=\"NormalTextRun SCXW251714441 BCX8\"> and survivors must receive the right response.<\/span><\/span><\/p><p><span class=\"TrackChangeTextInsertion TrackedChange SCXW246203107 BCX8\"><span class=\"TextRun SCXW246203107 BCX8\" lang=\"EN-GB\" xml:lang=\"EN-GB\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW246203107 BCX8\">Eight<\/span><\/span><\/span> <span class=\"TextRun SCXW246203107 BCX8\" lang=\"EN-GB\" xml:lang=\"EN-GB\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW246203107 BCX8\">years on, the campaign has seen critical changes \u2013 including the g<span class=\"TrackChangeTextInsertion TrackedChange SCXW246203107 BCX8\">overnment <\/span>leading an expert review on domestic abuse and the family courts (the \u2018Harm Panel\u2019 report), which Women\u2019s Aid sat <span class=\"TrackChangeTextInsertion TrackedChange SCXW246203107 BCX8\">on the panel <\/span><span class=\"TrackChangeTextInsertion TrackedChange SCXW246203107 BCX8\">for<\/span>. As a result of this review, the g<\/span><\/span><span data-contrast=\"auto\">overnment <\/span><span data-contrast=\"auto\">banned perpetrators from directly cross-examining survivors and are piloting a more safety-focused, trauma-aware and investigative court model.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:278}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">Despite these developments, <span class=\"TrackChangeTextInsertion TrackedChange SCXW176441092 BCX8\"><span class=\"TextRun SCXW176441092 BCX8\" lang=\"EN-GB\" xml:lang=\"EN-GB\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW176441092 BCX8\">survivors<\/span><\/span><\/span> <span class=\"TextRun SCXW176441092 BCX8\" lang=\"EN-GB\" xml:lang=\"EN-GB\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW176441092 BCX8\">still tell us that they have been re-victimised and traumatised by their abusers through the family court process. Even though this would technically not apply to survivors, we know that many survivors do not have accepted forms of \u2018evidence\u2019 of their abuse and may end up in mediation with their perpetrator regardless.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:278}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">Women\u2019s Aid responded to this consultation, setting out how compulsory mediation could harm survivors and give perpetrators more opportunities to abuse and control. In addition, we coordinated a letter signed by 30 women\u2019s sector organisations to the Justice Minister. <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:278}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">We are very pleased that our concerns have been heard. The government response to the consultation said: <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:278}\">\u00a0<\/span><\/p><blockquote><p>Many respondents to the consultation were concerned that the proposed exemptions would not be enough to adequately protect survivors of domestic abuse from being required to attend mediation when it is not suitable or safe for them. We are not proposing to change the law to introduce a requirement on parties to attend mediation before applying to court at this time. Instead, we will focus on delivering the package of measures that helps parents\/carers resolve their issues at every stage of the process.<\/p><\/blockquote><p><span data-contrast=\"auto\">These measures include better domestic abuse training for mediators and screening processes, which Women\u2019s Aid is supporting the Family Mediation Council to develop. It claims the proposals will reduce the number of cases in the strained family justice system and ensure better outcomes for children.<\/p><p>We don\u2019t agree \u2013 these plans would be dangerous for survivors and their children. Whilst there would be an exemption from compulsory mediation in cases of domestic abuse, we know that many survivors will not be able to access it \u2013 because they are afraid to disclose abuse or because they do not have one of the required forms of evidence.<\/p><p>Mediation is likely to be unsafe for many survivors. Perpetrators may use the process to further abuse them and force them into decisions about child contact which they don\u2019t believe are safe. Survivors need the protection of court from abusers\u2019 strategies of coercion and control.<\/p><p>These plans go against the government\u2019s commitment to make the family courts safe for child and adult survivors. In our response to the consultation, we are urging the Ministry of Justice to reconsider and to instead prioritise implementing the Harm Panel\u2019s recommendations to make the family courts safer, trauma-aware and child-centric.<\/p><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-toggle-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-5524\" class=\"elementor-tab-title\" data-tab=\"4\" role=\"button\" aria-controls=\"elementor-tab-content-5524\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon elementor-toggle-icon-left\" aria-hidden=\"true\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon-closed\"><i class=\"fas fa-caret-right\"><\/i><\/span>\n\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon-opened\"><i class=\"elementor-toggle-icon-opened fas fa-caret-up\"><\/i><\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t<a class=\"elementor-toggle-title\" tabindex=\"0\">May 2023<\/a>\n\t\t\t\t\t<\/div>\n\n\t\t\t\t\t<div id=\"elementor-tab-content-5524\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"4\" role=\"region\" aria-labelledby=\"elementor-tab-title-5524\"><p><strong>Government publishes progress update on the Harm Panel report<\/strong><\/p><p>Three years on from the \u2018Harm Panel\u2019 report, a landmark review of domestic abuse and the family courts, the government has published an update on their progress towards the recommendations.<\/p><p>A justice minister claimed the government has made \u2018huge strides\u2019 and \u2018delivered cultural changes across the family justice system to ensure domestic abuse victims feel supported and protected\u2019. But we are still hearing reports of survivors who raise domestic abuse being disbelieved and discriminated against, experiencing trauma and further abuse throughout the process.<\/p><p>Whilst there have been positive changes in the three years \u2013 like support workers being allowed to accompany survivors into court and the ban of direct cross-examination by perpetrators \u2013 these have not been enough to transform survivors\u2019 experiences.<\/p><p>We are continuing to push for all 32 of the Harm Panel\u2019s recommendations to be implemented to ensure safety in the family courts for adult and child survivors.<\/p><p>Read our full comment on the Harm Panel progress update\u00a0<a title=\"Original URL: https:\/\/womensaid.org.uk\/womens-aid-responds-to-the-harm-panel-progress-report\/. The report\u00a0concluded that the family courts do not effectively protect many child and adult victims of domestic abuse\u00a0from further harm. It made a number of recommendations which, if implemented, would transform the family court response to domestic abuse.<\/span><\/p><p><span class=\"x_normaltextrun\">Two years later, Women\u2019s Aid has published a new report:\u00a0<a title=\"https:\/\/womensaid.org.uk\/wp-content\/uploads\/2022\/06\/Two-Years-Too-Long-2022.pdf\" href=\"https:\/\/womensaid.org.uk\/wp-content\/uploads\/2022\/06\/Two-Years-Too-Long-2022.pdf\" target=\"_blank\" rel=\"noopener noreferrer\" data-auth=\"NotApplicable\" data-linkindex=\"2\">Two years, too long<\/a>. In the report we ask what progress has been made since the publication of the Harm Report, and what work remains to be done. Our report is informed by the experiences of survivors who have been in court since 2020, and the specialist services supporting them.\u00a0<\/span><\/p><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-toggle-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-5526\" class=\"elementor-tab-title\" data-tab=\"6\" role=\"button\" aria-controls=\"elementor-tab-content-5526\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon elementor-toggle-icon-left\" aria-hidden=\"true\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon-closed\"><i class=\"fas fa-caret-right\"><\/i><\/span>\n\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon-opened\"><i class=\"elementor-toggle-icon-opened fas fa-caret-up\"><\/i><\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t<a class=\"elementor-toggle-title\" tabindex=\"0\">May 2021<\/a>\n\t\t\t\t\t<\/div>\n\n\t\t\t\t\t<div id=\"elementor-tab-content-5526\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"6\" role=\"region\" aria-labelledby=\"elementor-tab-title-5526\"><p>On 29<sup>th<\/sup>\u00a0April 2021, the\u00a0<a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/2021\/17\/contents\/enacted\">Domestic Abuse Act<\/a>\u00a0reached royal assent and finally became law. The Act contains a number of new provisions that will help to make the family courts safer for survivors and their children. These include:<\/p><ul><li>The first ever statutory definition of domestic abuse which recognises children as victims in their own right.<\/li><li>Victims of domestic abuse will be automatically eligible for special measures in the family courts. There will also be provisions in the civil courts for some survivors to access special measures.<\/li><li>Perpetrators or alleged perpetrators of abuse will be prohibited from directly cross-examining their victims in person in the family and civil courts, where there are convictions or evidence of domestic abuse. The courts will also have discretion to prevent cross-examination in other circumstances.<\/li><li>Clarity that the family courts should use barring orders (an order under section 91(14) of the Children Act) to prevent the family courts from being used to continue abuse.<\/li><\/ul><p>These changes have been hard fought for throughout the Child First campaign, but we recognise that systemic change is still needed throughout family justice. As we reach the first anniversary of the\u00a0<a href=\"https:\/\/www.gov.uk\/government\/consultations\/assessing-risk-of-harm-to-children-and-parents-in-private-law-children-cases\">Ministry of Justice expert harm panel\u2019s report<\/a>, we continue to push for implementation of the report\u2019s recommendations, which highlighted the importance of redesigning the family justice system to respond safely to survivors and their children.<\/p><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-toggle-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-5527\" class=\"elementor-tab-title\" data-tab=\"7\" role=\"button\" aria-controls=\"elementor-tab-content-5527\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon elementor-toggle-icon-left\" aria-hidden=\"true\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon-closed\"><i class=\"fas fa-caret-right\"><\/i><\/span>\n\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon-opened\"><i class=\"elementor-toggle-icon-opened fas fa-caret-up\"><\/i><\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t<a class=\"elementor-toggle-title\" tabindex=\"0\">March 2021<\/a>\n\t\t\t\t\t<\/div>\n\n\t\t\t\t\t<div id=\"elementor-tab-content-5527\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"7\" role=\"region\" aria-labelledby=\"elementor-tab-title-5527\"><div class=\"kleo_text_column wpb_text_column wpb_content_element \"><div class=\"wpb_wrapper\"><p>Women\u2019s Aid, along with Rights of Women, Rape Crisis England and Wales, and Welsh Women\u2019s Aid, intervened in four joined appeals relating to domestic abuse and the family courts. The findings of the panel mark major progress for our Child First campaign.<\/p><p>Women\u2019s Aid was represented on the panel of experts guiding the review of evidence and has fought to ensure survivors voices are heard at every stage. The panel\u2019s report concludes that family courts do not effectively protect many child and adult victims of domestic abuse from further harm. In fact, the courts\u2019 pro-contact culture result in children and non-abusive parents being put at risk of often severe harm. We were pleased that the government listened to our calls for a wider ban on cross-examination to protect all survivors who face this traumatising practice in the court system. But there remains a long way to go before the family courts will be truly safe for women and children. The law must make survivors automatically eligible for special protection measures in the family and civil courts, not only the criminal courts. The Practice Direction outlines what judges and magistrates must do when overseeing child contact cases where domestic abuse is alleged or has taken place. \u00a0The review makes various suggestions to improve the practice direction including a clear definition of \u2018harm\u2019, addressing the \u2018contact at all costs\u2019 culture of the family courts and always putting children\u2019s interest and safety first.<\/p><\/div><\/div><div class=\"kleo_text_column wpb_text_column wpb_content_element \"><div class=\"wpb_wrapper\"><p>Women\u2019s Aid\u00a0marked the first anniversary\u00a0of the launch of the Child First campaign and report<em>\u00a0Nineteen Child Homicides<\/em>\u00a0by handing the\u00a0<a href=\"https:\/\/you.38degrees.org.uk\/petitions\/child-first-safe-child-contact-saves-lives\">Child First petition<\/a>\u00a0into Number 10 Downing Street.
